Buyer's quality examination of supplier's inventory products and raw materials
 
The buyer shall have the right to conduct routine quality examination on the supplier, and the supplier shall give necessary cooperation. In the event that the buyer finds product quality problems or risks, and the quality control fails to meet the requirements of the supplier Datasheet and the Product Specification, the buyer has the right to take the following measures:
 
1) To require suppliers to stop production of products suspected of quality problems and improve quality and further submit QC8D report to the buyer according to the requirements of the buyer;
 
2) In case of the products suspected of quality problems, the supplier shall assume liability for breach of contract in accordance with the Article 8, and the buyer has the right to decide whether to terminate the supplier's qualification as the provider of buyer. 

The supplier shall organize the analysis and disposal immediately after the quality problem is discovered or the Quality Feedback Form is received from the buyer within the specified period as follows:
 
1) The supplier shall take temporary measures within 24 hours;
 
2) The supplier shall give preliminary analysis on the causes and outflow reasons (for which the manufacturer failed to detect the quality problems before delivery but the buyer did) within 2 working days;
 
3) If the original manufacturer is in China, the supplier should provide effective reports of analysis, improvement and verification in the form of QC 8D within 3 working days. If the original manufacturer has to return to its country for product analysis, the supplier should provide effective reports of analysis, improvement and verification in the form of QC 8D within 10 working days.
 
 
买方对供方库存产品及其原材料的质量稽核
 
买方有权对供方进行例行质量稽核,供方应当给予必要的配合。买方在稽核中发现供方供货产品存在质量问题/隐患,质量管控不能满足供方Datasheet和《产品规格书》要求时,买方有权采取如下措施:
 
1) 要求供方停止生产已涉嫌质量问题的产品,按买方要求进行质量改善并向买方提交QC8D报告;
 
2) 根据涉嫌质量问题的产品,按照第8条要求供方承担违约责任,并有权视情况决定是否停止供方作为买方的供应商资格。

供方应当在自发现质量问题或接到买方的《供货质量反馈单》后立即组织分析和处理,处理期限如下:
 
1) 供方应当在24小时内采取临时处理措施;
 
2) 供方应当在2个工作日内给出初步产生原因、流出原因(即原厂商在产品出厂时未能发现但买方发现的质量问题)的分析;
 
3) 原厂商在国内的,供方应当在3个工作日内以QC 8D的格式给出有效的分析、改善、验证报告。产品需要返国外原厂商进行分析的,供方应当在10个工作日内以QC 8D的格式给出有效的分析、改善、验证报告。
